State Shura Council halts the implementation of the Minister of Labour's decision granting permits for Palestinians born in Lebanon to practice professions that the law has restricted to Lebanese
The Shura Council issued a decision No. 93 dated February 3, 2022 to stop the implementation of the minister of labour's decision issued on Nov. 25, 2021, No. 1/96, for exceeding the limit of authority through granting permits for Palestinians born in Lebanon to practice professions that the law has restricted to Lebanese.
Labor Minister Mostafa Bayram’s decree sought to allow “Palestinians born in Lebanese territories and officially registered with the Ministry of Interior” to work in professions requiring syndicate membership from which they had previously been barred.
In late December, the Maronite League sent an appeal to the State Shura Council, claiming that the ministerial decision had “formal” flaws and violated “constitutional bases and Lebanon’s high-level policies preventing nationalization.” The appeal was sent through the league's attorneys Rizk Zougheib and Antoine al-Houweis.
وطنية - أعلن رئيس الرابطة المارونية النائب السابق نعمة الله ابي نصر في بيان، أن "مجلس شورى الدولة أصدر قرارا يحمل الرقم 93 تاريخ 3 شباط 2022 بوقف تنفيذ قرار وزير العمل الصادر في 25 تشرين الثاني 2021 ورقمه 1/96، لتجاوزه حد السلطة من خلال الاجازة للفلسطينيين المولودين في لبنان ممارسة المهن التي حصرها القانون باللبنانيين فقط".
وأشاد ابي نصر بـ"قبول مجلس الشورى بإجماع الهيئة الحاكمة مراجعة الرابطة بهذا الشأن التي سبق ان تقدمت بها في الثامن والعشرين من كانون الأول 2021"، مشيرا الى أن "قرار مجلس الشورى اعتبر أن المراجعة ترتكز على اسباب جادة ومهمة، بعدما تبين له من معطيات الملف ومن الأوراق المبرزة فيه، أن شروط وقف التنفيذ متوافرة في المراجعة الراهنة. واعتبر المجلس أنه يتمتع بقرار وقف التنفيذ اذا تبين له من ملف الدعوى أن التنفيذ يلحق ضررا بالمستدعي، وذلك سندا إلى أحكام الفقرة 2 من المادة 77 من نظام مجلس شورى الدولة".
وعلق ابي نصر على القرار بالقول: "أكد صفة الرابطة المارونية ومصلحتها في الطعن بقرار وزير العمل وكل القرارات الماسة بالمصلحة العامة. كما ثبت صفة الرابطة ومصلحتها في ملاحقة اي قضية ترى انها تلحق بحقوق اللبنانيين والطائفة المارونية الضرر البالغ. وهو ما يندرج ضمن الأهداف المحددة في نظام انشاء الرابطة".
